Our Privacy Policy was developed to combine quality products and services with integrity in dealing with our clients. The Policy is designed to assist you in understanding how we collect, use and protect the personal information you provide to us and to assist you in making informed decisions when using our site and our products and services.
This privacy statement applies to the website of http://www.hawaiianid.com. Hawaiian Inspired Design is committed to protecting your privacy. In order to provide a quick and accurate response to your order, we only ask for the information necessary to complete your order. Providing additional information will help us to meet your needs with precision.
All the information is strictly for the use of Hawaiian Inspired Design and will never be shared with any third party at any cost.
Hawaiian Inspired Design uses Google Checkout which is a secure Internet payment processor. For your safety and privacy, all credit card information is sent directly to Google Checkout.
When you order, we need to know at least your name, your company's name, your email address, and your mailing address. This allows us to process and complete your order and to notify you of your order status. We also ask some information about your company in order to get an idea of your goals and overall purpose of the company. These directions will help us to meet you needs. All the rights to the artwork and design we create at the request of a client belong to that client.
Hawaiian Inspired Design does not send unsolicited emails or spam of any kind.
Order Process
All orders must be done online through our website (
http://www.hawaiianid.com) or in writing via email or fax. All design orders are acknowledged via email or fax.
Once we receive payment for the service/product you requested, we will begin the process immediately based on your order form details. If we have any questions, we will email you and await your response.
Hawaiian Inspired Design has the right to refuse any project for any reason. In this case, you will receive a complete refund if you have already paid.

Services
By purchasing the services of Hawaiian Inspired Design, you agree to be legally bound by these Terms and Conditions, including those terms and conditions incorporated by reference. If you do not accept these Terms and Conditions stated here without modification, you may not use the services provided. We may modify these Terms and Conditions at any time.
With respect to the logo, website and brand development package selected, clients are allowed to choose only one design of each package. All designs, concepts, taglines or other materials displayed to the client that are not selected by the client remain the full property of Hawaiian Inspired Design. Clients can purchase additional designs provided within the samples created to fulfill the order for an additional price depending on the requested services and/or items.
Refund Policy
Hawaiian Inspired design guarantees your full satisfaction. Refunds are granted only prior to selection of the first draft samples. Once a sample is chosen either for use or for a redraw improvement, refunds will not be given.
The refund policy will NOT take into effect in any of the following events:
You have provided feedback regarding your initial samples.
Your company is no longer in business.
You have purchased a “Special Package”.
You have approved your design on the initial designs.
You have commenced on one concept of our samples and 3 or more revisions were made at your request.
How the money will be returned:
If you have paid using a credit card, the money will be transferred back to your credit card account. It may take up to 7 business days before the money will appear on your account. If you have paid via check, your refund will be sent to you by check as well.
Cancellation
If any order is cancelled or changed after sample approval and revisions have been prepared or T-shirts have been produced, the client will be required to pay for all work completed at the time of the cancellation or change. Cancellations and changes will only be accepted in writing.
Returned Check Policy
$ 30.00 service charge for all returned checks is required.
Payment Terms
Clients who do not have an account with us are required to pay the total amount in full before the product will be delivered. Net 30 Day payment for customers with an established account. Payment must be made in U.S. dollars. We accept Visa, MasterCard, and American Express.
Legal Rights Agreement
All rights to the design and artwork created by Hawaiian Inspired Design, designed for clients (excluding T-Shirt designs, since the designs are not created for a specific client), belong to the client it was designed for. We do not hold any rights to the designs created for the clients. The client may register his/her name, logo, tagline, or similar under his/her trademark. We do not file a trademark application.
It is the sole client’s responsibility to research their company name, and to ensure the name is not already in use. Hawaiian Inspired Design is not and will not be held responsible for any legal action that may result from improper due diligence on the company name, any other text or images provided. The client has the authority and legal right to utilize artwork, logos, text, company name, and other material he/she provides us.
In the event that payment for any design is not made in accordance with the payment policies of Hawaiian Inspired Design, then all of the client’s rights in and to the design created for the client, including any trademark property, will immediately revert back to Hawaiian Inspired Design.
Hawaiian Inspired Design warrants that its designs are of its own creation and are not copied from or inspired by existing designs or trademarks but does not warrant that a design the same or similar to that designed, but of which we were not aware at the time of its creation, does not exist.
If for some coincidental reason a logo, website, tagline, mission statement or any other graphics designed by Hawaiian Inspired Design looks identical to another company, we will provide a free redraw session. Hawaiian Inspired Design will not be held liable under these circumstances.
Any scan, copy, fax, etc. provided by the client that Hawaiian Inspired Design is asked to use in the project removes its responsibility from any copyright violation or warranties. In such circumstances Hawaiian Inspired Design cannot guarantee the originality of its work and therefore will not be held liable for any damages or violations.
A waiver form is required to sign prior to Hawaiian Inspired Design using any images provided by the client.
You agree that you have the needed and required rights and permissions on all content uploaded to your website. Files such as music, photos, videos and other, must be accompanied by permission in writing from current copyright or license holder(s). Upon notification and proof of copyright infringement, your website may be suspended or terminated.
Claims
Claims for any defective service/product must be made no later than 7 days after product has been delivered.
Must be over 18
These Terms & Conditions must be completed, understood and agreed to by a person over 18 years old. If a parent or guardian wishes to permit a person under 18, and under his or her supervision, to use this site, he or she should contact Hawaiian Inspired Design via email or fax with his or her explicit permission and acceptance of full legal responsibility for the minor to do so.
Ownership
All final artwork becomes the property of the client who has unlimited and royalty-free use of the design upon payment of all fees. Hawaiian inspired Design keeps the right to display the design(s) in the portfolio and advertising materials.
Project Duration/Time Lines
Client agrees to provide timely responses to Hawaiian Inspired Design after notification of sample completion. Client shall have 1 month to respond to each set of design samples submitted for review. If after 1 month the Client has failed to respond, we will assume the project complete and it shall be deemed to be complete. Hawaiian Inspired Design will have no further obligation to the client, and the client shall pay us all fees and expenses associated with work performed.
Font Information
Hawaiian Inspired Design will provide all font names used in the design process.
But we do not provide the actual font files.
Domain Name
Hawaiian Inspired Designs registers and retains ownership of custom domain names for use with client accounts. Hawaiian Inspired Design services domain names. Selected domain names may be transferred to clients upon request and approval. A domain transfer fee applies unless otherwise noted or quoted. The client is then responsible for all renewal, web hosting and other associated fees of maintaining own domain name. Hawaiian Inspired Design does not offer support for domain names once transferred.
LogoDesign, Revisions and Final Approvals
The general delivery time line for the first logo design concept is 5 business days.
Every following change will be delivered in 1-2 business days. More complex changes or revisions may take up to 5 business days (depending on the complexity of work).
We will try to provide logo samples within 5 business days. We will email your compete logo files as soon as the logo is completed. Electronic files will be provided in .ai, .eps, .gif, and .jpg. You may request additional file formats at the time of order.
Please note that once you give a final approval on your logo you may only request another logo change/revision at an additional charge. The charge depends on the amount of work involved, but the minimum additional charge for changes to approved logos is $50.
Upon the final approval of a logo, Inspired Design will require up to 1-2 business days to put together all of the files. For delivery packages the shipment will be processed after we receive your address confirmation.
Loss of Data
Hawaiian Inspired Design will take all appropriate safety measures to protect its servers and data contained within, however Hawaiian Inspired Design will not be held responsible for any loss of client data stored or intended to be stored on the servers and on back-up devices.
The client will not be entitled to any form of compensation from Hawaiian Inspired Design in the event of loss of data, therefore it is recommended that the client also takes steps to back up his/her materials.
Prices & Services
Hawaiian Inspired Design may make changes to the website and information provided, i.e. publications, prices, technical specifications, promotions and product offerings at any time and without notice.
The website contains our most up-to-date pricing and product specification. We are not responsible for incorrect information listed on search engines and other websites.
RBG, CMYK, Pantone colors and responsibilities
Hawaiian Inspired Design will supply your design(s) with files in different color modes such as RGB, CMYK, and may contain Pantone colors. When you are approving your design on the computer monitor, you are only approving RGB colors. Computer screens can only reproduce RGB colors and only “fakes” other color modes. We do our best to match RGB colors on our computer screen to CMYK or Pantone colors, but it is actually impossible to find an exact match. When we transform your designs in to different color modes (CMYK, Pantone) we hold no responsibility for matching exactly your approved RGB colors. It is the clients’ responsibility to double-check and make sure the printer gets the right color.
Indemnification
You agree to defend, indemnify, and hold harmless Hawaiian Inspired Design, its advertisers, licensors, subsidiaries and other affiliated companies from all liabilities, claims, and expenses, including attorney's fees, that arise from your use of all products, information and services provided by Hawaiian Inspired Design to you. Hawaiian Inspired Design reserves the right, at it own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with us in asserting any available defenses.
